Terms of Service

 

§1 Validity of the Conditions

 

The deliveries, services and offers of petitesteps.ch are made exclusively on the basis of these terms and conditions, even if they are not expressly agreed upon again. These conditions are considered accepted by ordering the goods or services. General conditions of purchase of the buyer is hereby contradicted. Deviations from these terms and conditions are only effective if we confirm them in writing.

 

§ 2 Offer and Conclusion of Contract

 

The offers of petitesteps.ch are binding only after written confirmation. Order confirmations are only prepared upon expressly request. The information in our sales documents (drawings, illustrations, dimensions, weights and other services) are to be understood as indicative only and do not represent any assurance of any features, unless expressly stated in writing as binding. We are released from our delivery obligation if a buyer exceeds his credit limit by placing an order.

 

§ 3 Prices

 

Decisive are the prices stated in our order confirmation. These are fixed for stock goods at the time of the order. In case of delivery bottlenecks and errands, the daily price on the day of order applies. The prices - unless agreed differently - include 8% VAT and exclude shipping costs.

 

§ 4 Shipping Time

 

Dates and delivery times are not binding, unless agreed in writing differently. The specific delivery dates and timelines given by petitesteps.ch are subject to the correct and timely delivery to petitesteps.ch by suppliers and manufacturers.

 

§ 5 Shipping

 

Shipping is only possible within Switzerland.

Visible differences in quantity must be reported to petitesteps.ch and to the carrier in writing immediately upon receipt of goods, hidden differences in quantity must be reported within 4 days of receipt of the goods. Complaints regarding damage, delay, loss or bad packaging must be reported immediately after receipt of the consignment.

The shipping takes place at the expense of the buyer by parcel post, forwarding agency or own vehicle, unless otherwise expressly agreed.

 

§ 6 Transfer of Risk

 

The risk passes to the buyer as soon as the consignment has been handed over to the person carrying out the transport. The risk passes to the buyer with the notification of readiness for shipment if the shipment is delayed or becomes impossible outside of our fault. Individual agreements about taking over the shipping costs by petitesteps.ch have no influence on the transfer of risk.

 

§ 7 Warranty

 

The warranty is 2 years in accordance with the following provisions, unless expressly agreed in writing differently. The warranty period begins with the delivery date. If our operating or maintenance instructions are not followed, changes made, parts replaced or consumables used that are not in accordance with the original specifications, then any warranty is void if the defect is attributable to it. This also applies, as far as the defect is due to improper use, storage and handling of the product, or due to foreign intervention or the way of opening the product. Insignificant deviations from warranted characteristics of the goods do not give rise to claim any warranty rights. A liability for normal wear and tear is excluded. Warranty claims against petitesteps.ch are only available to the immediate purchaser and are not transferable.

 

§ 8 Returns

 

In case of returns we require that the defective part or product is sent to petitesteps.ch or to the address specified by petitesteps.ch for repair, including a completed repair form - if delivered with the product - and a copy of the invoice. Shipping costs have to be paid by the customer. By the replacement of parts, assemblies or entire products do not come new warranty periods into force. The warranty is limited exclusively to the repair or replacement of the damaged delivery items.

 

§ 9 Retention of title

 

The delivered goods remain the property of petitesteps.ch until full payment.

 

§ 10 Payment

 

A payment is deemed to be made only when we have received the amount. We are entitled to charge an interest of 10% from the relevant date if the buyer is delayed with the payment. The petitesteps.ch is also entitled at any time to withdraw from the contract during the duration of the delay in payment.

 

§ 11 Limitation of Liability

 

Any liability for consequential damage resulting from the use of the products is rejected.

 

§ 12 Privacy

 

The petitesteps.ch is entitled to process the customer data relating to the business relationship according to the Federal Data Protection Act, whether these originate from the buyer or from third parties.

 

§ 13 Not redeemed vouchers

 

No compensation will be provided for vouchers not redeemed within the validity period.

 

§ 14 Jurisdiction

 

Maur is the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship. The legal relationship is subject to Swiss law.
